Dear Colleagues,
UCU negotiators met with management yesterday at the Common Interest Group meeting to present our response to the College’s new strategy.
The documentation presented by us is attached to this email. In addition to the response we have attached two appendixes;
·         Appendix 1 is the more detailed research document.
·         Appendix 2 is a synopsis of research carried out by Dr Matt O’Leary which is well worth reading.
We would also like to thank members for their comments which we sought to incorporate in the response document submitted.
Management have said that they will take our comments and documents away and reflect on them in detail and then arrange another meeting.
We are also in the process of arranging a branch meeting, details to be forwarded shortly, where this strategy will be a major item on the agenda.
We are aware that staff in some directorates are under pressure to undertake peer observations.
We would point out, and it was confirmed yesterday, that peer observations are not mandatory.
They may be encouraged, but it is up to individual members of staff to decide whether to do a peer observation or not.
Please speak to a branch rep if you require any further information or assistance in this regard.

TUC March October 20th 2012

The Tory Party Conference in Birmingham this week has launched a renewed war on working people and the poor.
Despite growing evidence that George Osborne's austerity polices are crashing the economy, they are now saying that they plan to continue their attacks and cut-backs for a further 6 years.
Osborne and Cameron's speeches have celebrated their attacks on the 99% and defended their tax cuts for the super rich. 
The conference has unveiled a string of further proposals to attack the weakest and most vulnerable in our society with a shameless attempt to vilify and scapegoat people on benefits.

The timing of next week's TUC March for a Future that Works on Saturday October 20th could not be more appropriate. 
Make sure that you join the hundreds of thousands who are due to take to the streets of London.

Quality Assurance Improvement Strategy

Chesterfield College Proposals on Quality Assurance Improvement Strategy Help Us to Develop a UCU Response:

Please let us know your views by this Friday, 5 October.

All staff will have received an email containing the college’s proposals for a Quality Assurance Improvement Strategy. This contains proposals on formal graded observations. These are vitally important for all teaching staff at the college.

UCU both nationally and here at the college have long campaigned for changes to the observation policy arguing for policies that support staff and which are not punitive.

The Chesterfield College UCU branch is seeking the views of our members on the issues raised by the college’s proposals.

Please contact one of your union officers, Paula Alsop, James Eaden, Allister Mactaggart, & Sam Parker and feedback any views that you have about the college’s proposals.

Already a number of concerns have been raised by UCU members. Your UCU branch officers will be meeting with the college in the week beginning October 8th to feedback members’ views.

Some of the issues raised so far by UCU members at Chesterfield College include:

·        The policy calls for “at least “ one graded observation per year. UCU members have said that there should be one observation unless staff either request a further observation or if they are re-observed following a grade 4.

·        The policy suggests that there should be a pre- meeting between the observer and members of staff to be observed one week before the observation. Some UCU members have commented that this a positive step, however they believe that this meeting should clearly identify the session to be observed.

·        Some members have stated that there should be a right to “turn down” a particular observer and opt for an alternative from the panel of trained observers.

·        However by far the most serious concern raised by UCU members who have read the policy documents is the link between a grade 3 and the college’s formal capability procedure. This raises the possibility of staff being sacked as a result of getting a grade 3 - a grade that OFSTED suggests is a lesson where “teaching strategies ensure that learners’ individual needs are usually met”.


The issue of lesson observations is being addressed in FE Colleges around the country and the latest edition of the UCU’s FE News contains some very useful examples of agreements reached in other colleges over lesson observations. Please take a few minutes to read through the extract below.

observations campaigning are likely to be
presented in a seminar later in the 2012/13
year.

·        Chesterfield Remploy workers are taking their second week of strike action.

They need our support and solidarity.

Workers at Chesterfield's Remploy factory, members of the GMB, started their second full week of strike action in their fight to save their jobs last Thursday 27th September. Their strike will continue this week through to Wednesday October 3rd. Pickets will be out at the Remploy factory from 6.00am every morning and the Remploy workers and their supporters will once again be publicising their action on Chesterfield’s Whittington Moor roundabout.

Chesterfield Remploy workers will be taking their message to the Labour Party Conference in Manchester on Tuesday October 2nd and plan to join the TUC's March for a Future That Works in London on Saturday October 20th ( See below for details) 

The Remploy workers need our support and solidarity in their fight for the right to work with dignity and security. 

What you can do.
          Visit the Remploy picket lines. Pickets will be out from 6.am to 12 noon daily from Monday to Wednesday ( 1st -3rd October). Come along to the Remploy factory and join the solidarity protest every morning next week at the Whitmoor roundabout. The Remploy factory is on Sheffield Road (B6057) Come off A61 at Whittington Moor Roundabout, take Station Road (B6502)exit signposted  Old/New Whittington, turn immediately left before railway bridge into Brimington Road North(B6057) which becomes Sheffield Road. Remploy is a few hundred yards on your right (go past the car showrooms).

UCU members at Chesterfield College are being balloted on the final offer made to the trade unions by the College

In March the college formally notified UCU and the other unions of their intention to make staff redundant and to introduce a number of significant changes to pay and conditions. UCU immediately rejected these proposals and conducted an industrial action ballot which resulted in an 88% vote for strike action. Members took action on May 10th (as part of the national pensions campaign) and May 29th. During the subsequent meetings a number of proposals have been put forward. On June 23rd the college submitted their formal final offer to the unions as outlined in Trevor Clay’s Letter .
What follows is a brief outline of the various proposals that have been put forward by the college and what has subsequently happened to those proposals following action by UCU members and representation by your negotiators
College Proposals:
Redundancies:
The college sought to introduce  redundancies across the college, initially suggesting a reduction of 10% in teaching staff. During the process the college identified overstaffing in the majority of directorates. They announced that they would seek Voluntary Redundancies but that they would need to make Compulsory Redundancies if overstaffing was not met. By the time of the closing of the VR period the college identified 9.9 FTE teaching staff as still being at risk of redundancy.
The threat of compulsory redundancies has been withdrawn.
Reduction in Hourly Paid rates of pay.
The college proposed reducing the rates of pay for hourly paid lecturers in September 2012 to:
Unqual: £13.13
Part Qual 17.03
Qualified £21.56
Following lengthy negotiations the current proposals have proposed rates of pay for HPLs for September 2012 of with a further staged reduction in September 2013.

These rates do not represent a complete withdrawal of pay cut for HPLs, however rates have moved substantially from the position before UCU took action. Figures from UCU on comparable rates of Hourly Pay from other colleges in the East midlands region show that even with the cuts, the rates of pay at Chesterfield College remain higher than at many other colleges.

Removal of Learning Support lecturers from teaching contracts:
The college proposed to remove Hourly Paid Lecturers delivering learning support from teaching contracts and place them onto support staff contracts. This would have led to a 70% reduction in the hourly rate of pay for many of these staff.
This proposal has been withdrawn.
Bar on progression on salary scale:
The college made various proposals on placing a bar on the salary scale at point 32 for all lecturers, including only allowing progression for those getting a 1 or 2 in observations and taking on a junior management responsibility. They have also proposed putting a bar on the salary scale at point 22 for new unqualified lecturers.
All proposals to put a bar on the salary scale for qualified lecturers  have been withdrawn.
1% pay cut for all staff above sale point 18.
During the negotiations management tabled a proposals to introduce a 1% across the board reduction for all staff above point 18 on the salary scale. This would have impacted on the vast majority of teaching staff.
This proposals has been withdrawn.
2 year pay freeze:
The college required that all of the unions sign up to a two year pay freeze as part of signing any agreement.
This requirement has been withdrawn.
Additional point: During the negotiation the college also put forward a proposal for an extra “directed day” holiday per year.

UCU members at Chesterfield College will be balloted on the final offer made to the trade unions by the College. Members will be asked to vote on whether they accept or reject the latest proposals. 

Full details will be sent out in the accompanying material with the ballot papers.

We have yet to determine the exact timing of the ballot but we will try to make sure that enough time is given to allow all members to vote and return ballot papers over the holiday period.

UCU branch officers would like to thank all our members for their solid support over the last few difficult months. We believe that we have made significant progress in the negotiations which has only been possible because of the very firm support shown by members in the industrial action ballot and the strike action we have taken.

You will have all received a letter from Trevor Clay outlining the final offer made to the trade union side yesterday (Wednesday) afternoon. The offer marks a significant move from the previous position and UCU members will need to have an opportunity to consider and decide our response.

We will therefore be calling a full UCU branch meeting at the next suitable opportunity. Given the busy schedule on Monday and Tuesday of next week, Wednesday midday looks the mist likely option.

We will let members know the confirmed date, time and venue as soon as we have it.

There will be a UCU branch meeting today (Monday 18th)
at 4pm in Room S613, Infirmary Road - UCU Members Only

The meeting is to discuss the latest position put forward by Chesterfield College and to decide on UCU’s attitude and further steps in our campaign. The basic outlines of the current position as we understand it are shown below, and a more detailed presentation will be made at the UCU branch meeting.

As of today we understand that the college’s current proposals are:

1.     To introduce an across the board 1 % pay cut for all staff above point 18 on the salary scale.

2.     To announce a 1 year pay freeze.

3.     To introduce pay cuts of up to approximately 11% on hourly paid staff phased over two years.

4.     To restrict progress up the pay scale at point 22 for all new unqualified teachers.

5.     We understand that the management have shelved plans to introduce a bar at point 32 of the salary scale dependent on achieving grade 1 or 2 in a lesson observation, and will now carry out a review of the Internal Review process. They have also withdrawn proposals to make progression beyond point 32 dependent on taking up a “ junior management “ role.

6.     To allow one additional direct day of annual leave per year.

7.     There is a further proposal which will impact on staff who are not on the salary scale and which does not direct impact on staff represented by UCU.


The current management proposals do represent some improvement on the position we faced before the strike action on May 29th, however the college’s continued insistence on including a pay cut for all staff, and the scale and scope of cuts proposed for hourly paid staff remain key issues which prevent UCU from agreeing a negotiated settlement.

It is also significant that the other recognised union representing teaching staff at the college, NASUWT, have now formally announced a dispute with the college over their pay cut proposals and have served formal notice to the college of their intention to ballot their members for potential industrial action. Your UCU branch representatives are in close contact with NASUWT officials to co-ordinate our approach.
  
Report from UCU Congress:

The dispute at Chesterfield College was high on the agenda at the Manchester Central Conference Centre last week as over 600 UCU delegates from colleges and universities around the country met. Your branch reps at the congress were able to meet with national and regional officials of the union, and UCU delegates from around the country expressed their support and solidarity and also their shock at the measures that Chesterfield College are taking.

Our dispute at Chesterfield has been designated by UCU as a “Local Dispute of National Significance”. Only 2 FE Colleges in the country, Chesterfield and Sunderland ( who also face threats to pay) are currently classified  as such. UCU national officials report that Chesterfield is the only college in the country planning to make an across the board %age pay cut.

Chesterfield College remains one of the most financially healthy FE colleges in the country with significant cash reserves built up over many years. In last week’s Derbyshire Times there was a further announcement of college spending with further £2.5 million to be spent on a joint project with Chesterfield Borough Council. This is on top of the £ 3 million earmarked for the new Infirmary road entrance. UCU has no objection to money being spent on improving and upgrading facilities at Chesterfield College however it sends a very negative message to staff about our value if large scale spending projects are accompanied by pay cuts.

Christine has been a member of UCU’s National Executive Committee for the last 4 years and a strong and key branch officer at Manchester Metropolitan University for over 10 years.  As her department is reorganised, Christine is the only member of the team who has not been offered a suitable redeployment opportunity. She is now facing compulsory redundancy.  This is clear victimisation of a trade unionist and a very serious attack on our branch.
We need all the support we can get. We need to show management that the Branch and UCU more widely will not be disarmed by these vicious underhand tactics and will continue to fight for all our members’ rights, including Christine’s, in the face of attempts to mould education to business demands.

CAMPAIGN TO STOP PAY CUTS @ CHESTERFIELD COLLEGE

Dear colleagues ,

You will have received a letter this morning from the Principal outlining some proposals that were revealed to the joint unions at Chesterfield College at yesterday’s meeting of the Common Interest Group.

These new proposals mark some movement away from the original draconian measures that were rejected overwhelmingly by UCU members and are therefore to be welcomed.  

However, the College is still committed to cutting pay, including a 1% for all staff earning more than £18,000 and to a pay freeze for the academic year 2012/13. In response to this UCU’s negotiators, acting on the unequivocal mandate of our members in the recent ballot made it clear that we remain opposed to any pay cut in line with both the explicit views of our members and the national policy of the union.

UCU is a democratic organisation so no change to that position can occur without the endorsement of the branch. Accordingly, we will be convening a full union branch meeting shortly after the half term break to consider and discuss the college’s latest proposals. At that meeting it will be up to all our union members to determine the branch’s response to these new proposals and vote on the course of action they wish the branch to pursue. 

In his letter the Principal claims that he is “very heartened that two unions (representing over half of our staff) have recognised that this represented a fair and reasonable measure to reduce our pay costs significantly with a minimal effect upon staff.”  

There are however 5 recognised unions at Chesterfield College. Only two of these namely, AMiE representing managers, and UNISON representing some non teaching staff (many of whom are on salaries below the £18000 threshold) have given their support for the proposed 1% pay cut. We have yet to hear the views of UNITE representing non teaching staff and NASUWT representing lecturing staff. UCU, with over 220 lecturing staff in membership, represents the overwhelming majority of lecturing staff at the college and has made it clear that we are committed to defending nationally negotiated pay scales. A 1% pay cut represents a move away from those pay agreements and would be a dangerous precedent to set.

Once we have convened the branch meeting and established the views of our members we will return to talks with the management on this issue. We believe we have made substantial progress since the initial proposals were made and we remain hopeful that a negotiated solution to these issues can be found.

A big thank you to UCU members at the college for supporting yesterday’s strike action in such large numbers. Once again a particular thanks to those members who came along and did a stint on the picket lines. We had picket’s lines at Clowne Campus, Sheffield Rod and Infirmary Road and there were more UCU members on picket lines than at any time in the memory of anyone at the College.

Our picket lines on Sheffield Road report overwhelming support from passing traffic with a constant stream of car horns being tooted in support. Many thanks as well to those who brought solidarity greeting in person to our picket lines from UCU and other trade union branches.

We had visitors from the following UCU Branches: Barnsley College, Sheffield College, Nottingham Trent University, East Midlands Retired Members . We also received delegations from UNISON Derbyshire County, PCS Derbyshire, UNITE Chesterfield, GMB Chesterfield, & Chesterfield & District TUC.

We have also received over 50 messages of support from UCU branches and activists around the country which can be seen on the UCU blog and have set up an online petition which if you haven’t done so already, you could sign up to by following the link:

UCU Branch officers will be meeting today to plan the next step in our campaign, and in particular to build on the significant local community support that our stand against pay cuts is gathering. Over the half term week UCU’s national congress will be meeting in Manchester and the issue of attempted pay cuts at Chesterfield College will be a key agenda item.

We are a due to meet with the college management again today
(Wednesday 30th May ) to try to negotiate a settlement to the current dispute and once again hope that we can make some progress in those talks.
